First and foremost, be sure that everyone is okay. If you suspect even a small injury, wait until the paramedics arrive on site and check on the situation. Be sure that all people involved are safely off the road and out of traffic.
- If possible, take a few quick photos of the accident, and then move the car off the road and out of the way of traffic. The photos will help to document the scene for any possible investigation that may ensue. Also take photos of the damage to your car, as well as other cars; and take photos of anything which may explain your version of the events – such as a pothole in the road, or skid marks from another car.
- Call 911 and wait for the police to arrive. Even with a small accident, you may find yourself seeking medical help later on – and having official documentation of the event will help. In this day and age, police often arrive quickly as passers-by will call before you even have the opportunity. If there is a hit-and-run scenario, still call police and report the details.
- Ask for a copy of the police report once it is written up. This report should have all contact and insurance information for the parties involved.
- If you see a doctor, ask for copies of all findings and reports. If ongoing treatment will be needed, ask for a prognosis and keep all reports for your insurance company.
- Discuss your situation with your insurance company as soon as possible. As Florida is a no-fault insurance state, it is the responsibility of your insurance company to pay for your car – even if you were not at fault. Still, there may be extenuating circumstances whereby you may need to pursue legal action against the other party for damages. Check first with your insurance company as to your coverages, then contact an attorney if you feel that civil case may be necessary.
It is important for you to understand your coverages, as car accidents come in many forms. For instance, if you do not carry collision on your vehicle and you are hit, your insurance will not pay for the damage.
